Terms of Service and Licence Agreement

These terms apply to the TouchMenu software and to subscriptions bought on this website. They are also the end user licence agreement (EULA) for the software. "We" means Tuvshintulga, the maker of TouchMenu, based in Mongolia. "You" means the business that buys a subscription.
TouchMenu is sold only to businesses, for use in their trade, not to consumers. By buying a subscription or activating the software, you confirm that you are buying for a business and you agree to these terms.
1. The software
TouchMenu is desktop software for Windows that lets a restaurant's guests view the menu and order from their own phones over the restaurant's local network. You install and run it on your own computer. It is an ordering and table tool that you use next to your own till; see section 5.
2. Licence
A subscription gives you a non-exclusive, non-transferable right to use the software on one computer at a time, for your own business, while the subscription is active. You may not copy the software to other computers, resell it, rent it out, share your licence key, or try to get around the licence check.
You may not decompile, disassemble, reverse engineer or modify the software, including the third-party components it contains such as the Microsoft Visual C++ runtime, except where the law expressly allows it despite this limit.
3. Buying, renewal and cancellation
You buy your subscription through the checkout on this website from Lemon Squeezy, our reseller and merchant of record. Lemon Squeezy's Buyer Terms apply to the purchase itself: payment, tax and billing. These terms are the licence agreement for TouchMenu that the Buyer Terms refer to, and our Refund Policy applies as well.
Prices are shown on our pricing page in US dollars. Any VAT or sales tax is added at checkout.
Subscriptions renew automatically at the end of each month or year until you cancel. To avoid being charged for the next period, cancel before your renewal date using the link in your receipt email. If you cancel by contacting Lemon Squeezy instead, their Buyer Terms ask for at least 48 hours' notice before the period ends. After you cancel, the software keeps working until the end of the period you paid for.
To change plan, switch plans through the same link. Buying a second plan starts a second subscription, which renews until you cancel it.
If we change the price of your plan, we will tell you at least 30 days before it applies to you. The new price applies only from a renewal after that notice, and you can cancel before then.
4. Internet connection and the licence check
Guest ordering runs on your local network and does not need the internet. The software needs an internet connection on its computer to activate the licence, and it checks the licence about once a day when it is online. If the licence can't be checked for 14 days, or the subscription ends, TouchMenu stops taking orders until it can check the licence again or a valid key is entered. Your menu, orders and settings stay on your computer.
5. Not a cash register or fiscal system
TouchMenu is an ordering and table tool. It is not certified as a cash register, fiscal device, tax receipt system or invoicing system in any country. Its bills are pre-bills, not tax receipts or invoices, and its reports are internal summaries, not fiscal reports. TouchMenu does not calculate or add any tax or service charge.
You are responsible for the tax, receipt, invoicing, record-keeping and cash register rules that apply where you operate. That includes using a certified till, fiscal device or invoicing system where the law requires one, and giving guests the receipts and invoices the law requires from it.
6. What you are responsible for
You run your restaurant and decide how you use TouchMenu. In particular, you are responsible for:
- Your menu: dishes, descriptions, photos, prices, discounts and promotions. Enter prices the way the law says guests must see them, including any tax.
- Allergen and diet information: TouchMenu only shows what you enter. Keep it correct and complete, and make sure guests can ask your staff about allergens before they order.
- Guests' personal data: names, orders, chat messages and other guest data stored on your computer. You are the controller of that data. Tell your guests how you use it and answer their requests as the law requires. We have no access to it.
- The social features you turn on: chat, gifts, song requests, trivia and celebrations. You moderate them, act on complaints, and check age before serving alcohol, including drinks sent as gifts.
- Music: you need lawfully obtained music files and any licence for playing music in public, for example from your country's music rights organisation, before you play music to guests.
- Payments and tips: guests pay you directly, by cash, card or your own payment QR. TouchMenu does not process or check payments; it only keeps a tally of what your staff and guests enter in it. Tips are yours to handle under local law.
- Your computer and network: keeping them working and secure, making backups, protecting the guest Wi-Fi with a password, and keeping card terminals and other payment devices on a separate network that guests can't reach. Guests' phones talk to your computer over your local network without encryption.
- Guests who can't use the phone menu: offer them another way to order, for example a printed menu and staff entering the order.
- Following the other laws that apply to your restaurant.
You will cover us against claims from others that come from your menu content, your guests' use of the social features, the music you play, or your tax and fiscal duties.
7. Your content and data
You keep the rights to the photos, logos, texts and music you add to TouchMenu, and you must have the right to use them. Your menus, orders and records are stored on your own computer, and we don't receive them. See our Privacy Policy.
8. Ownership and third-party software
The software, the TouchMenu name and logo, and our website and videos belong to us or our licensors. A subscription gives you only the rights in section 2.
The software includes open-source and other third-party components, such as the Microsoft Visual C++ runtime, under their own licences. Their notices come with the software.

9. Availability and support
We work to keep the software reliable and to provide updates and support, but we can't promise that it will be free of errors, always available or suit every situation. To the extent the law allows, the software is provided "as is", without warranties beyond those in these terms. The software needs a working computer and local network to operate, and an internet connection as described in section 4.
10. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits or lost data, or for fines, taxes or claims that come from how you run your business. Our total liability is limited to the fees paid for your TouchMenu subscription, to us or to Lemon Squeezy, in the 12 months before the claim.
11. Suspension and ending
You can end your subscription at any time by cancelling it (section 3). We may suspend or end your licence if you seriously break these terms, for example by sharing a key or getting around the licence check. Where practical, we will tell you first and give you a chance to put it right.
If we stop offering TouchMenu, we will tell you at least 30 days before and refund any time you paid for after the end date. When your licence ends, the software stops taking orders, and your data stays on your computer.
12. Changes to these terms
We may update these terms. If a change is significant, we will tell you by email or in the software before it takes effect.
13. Transfer
We may transfer our rights and duties under these terms to a company we control or to a buyer of the TouchMenu business, as long as your rights under these terms stay the same. We will tell you by email or in the software. Your licence is personal to you and can't be transferred (see section 2).
14. Governing law
These terms are governed by the laws of Mongolia. If a disagreement can't be settled by writing to us first, it will be decided by the competent courts of Mongolia. Nothing in these terms takes away rights you have under laws that can't be changed by agreement.
